Welcome to Modern Screens. These Terms of Service govern your use of our website and your purchase or use of our magnetic mosquito nets, retractable screens, Velcro screens, sliding window screens and other window and door screening products and services.
By requesting a quotation, placing an order, making a payment, approving a design or engaging Modern Screens for installation services, you agree to these Terms of Service.
1. About Modern Screens
Modern Screens supplies and installs modern screening solutions for residential and commercial properties.
Our services may include:
Magnetic mosquito nets
Magnetic window and door screens
Retractable screens
Velcro mosquito screens
Sliding window screens
Custom window screens
Custom door screens
Screen measurement and consultation
Screen installation
Screen repairs or adjustments where applicable
2. Quotations
Quotations are based on the information available at the time of assessment.
A quotation may depend on:
Window or door measurements
Number of openings
Screen type
Materials required
Installation requirements
Property location
Accessibility
Customer specifications
Unless otherwise stated, a quotation does not constitute acceptance of an order.
Quotations may be subject to change where measurements, specifications, quantities or installation requirements change before production or installation.
3. Measurements
Accurate measurements are important because many Modern Screens products are custom-made.
Where measurements are taken by Modern Screens, we will make reasonable efforts to ensure they are accurate.
If measurements are supplied by the customer, the customer is responsible for ensuring that the measurements provided are correct unless Modern Screens has subsequently verified them.
Changes to window or door dimensions after approval may result in additional costs.
4. Custom-Made Products
Many of our screens are made specifically for individual windows and doors.
Once a custom order has been approved and production, fabrication or material preparation has commenced, the order may not be cancellable or refundable except where required by applicable law or where Modern Screens agrees otherwise.
Customers should confirm the screen type, measurements, design, colour, quantity and other specifications before production begins.
5. Product Selection
Modern Screens may recommend a particular screen based on the customer's window or door design, intended use and requirements.
However, the final product selection is made based on the specifications approved by the customer.
Where a customer changes their preferred product after approval or production has begun, additional charges may apply.
6. Deposits and Payments
A deposit may be required before production, fabrication or installation begins.
The required deposit and payment schedule will be communicated to the customer before the order is confirmed.
The customer agrees to pay the outstanding balance according to the agreed payment terms.
Where a payment is overdue, Modern Screens may delay production, delivery or installation until the outstanding amount has been settled.
7. Installation
Where installation is included, Modern Screens will install the agreed screening system at the agreed property or location.
Customers are responsible for providing reasonable access to the installation area.
The installation area should be reasonably accessible, clear and safe for the installation team.
If access is unavailable or conditions at the property prevent installation, the appointment may need to be rescheduled.
Additional costs may apply where significant additional work is required beyond the agreed installation.
8. Property Conditions
Modern Screens is not responsible for damage caused by pre-existing structural problems, defective window or door frames, weak surfaces, unstable structures or conditions that could not reasonably be identified before installation.
Where our team identifies a potential installation problem, we may inform the customer and recommend an alternative solution.
The customer is responsible for informing Modern Screens of known structural, electrical, plumbing or other conditions that may affect the installation.
9. Installation Adjustments
Minor adjustments may sometimes be necessary during installation to ensure that a screen operates correctly.
Where an adjustment is reasonably within the scope of the agreed installation, Modern Screens will endeavour to complete it as part of the installation.
Where additional construction, structural modification or work outside the agreed scope is required, the customer may be responsible for the additional cost.
10. Product Use
Customers are responsible for using the screens according to the instructions provided.
Screens should not be subjected to excessive force, deliberate damage, inappropriate modifications or use for purposes for which they were not designed.
Customers should take reasonable care when opening, closing, removing, cleaning or retracting screens.
11. Damage and Repairs
Modern Screens may provide repair or adjustment services where available.
Damage resulting from misuse, accidents, pets, vandalism, excessive force, unauthorised modifications or improper maintenance may not be covered by any warranty or free repair commitment.
Repair or replacement charges may apply.
12. Warranty
Where a specific warranty is provided for a product or installation, the applicable warranty period and conditions will be communicated to the customer.
A warranty generally applies only to defects covered by the relevant warranty and does not automatically cover damage caused by misuse, accidents, modifications, normal wear and tear or external factors.
The customer may be required to provide proof of purchase or other order information when making a warranty claim.
13. Warranty Exclusions
Unless specifically agreed otherwise, warranty coverage may not apply to:
Accidental damage
Misuse
Excessive force
Unauthorised repairs or modifications
Damage caused by pets
Vandalism
Normal wear and tear
Failure to follow maintenance instructions
Damage caused by external events
Alterations to the original window or door
Changes to the installation area after installation
14. Delivery and Collection
Where delivery is included, the delivery arrangements will be communicated to the customer.
Delivery times may depend on product availability, fabrication, location, traffic, weather, access and other circumstances beyond our reasonable control.
The customer should ensure that someone is available to receive the order where required.
15. Cancellation
Customers may request cancellation of an order before production or fabrication begins.
Once materials have been purchased specifically for the order, fabrication has started or custom production has commenced, cancellation may not be possible.
Any refund will be handled according to the Modern Screens Refund Policy and applicable law.
16. Refunds
Refunds are subject to the Modern Screens Refund Policy.
Because many products are custom-made, customers should carefully confirm all specifications before approving an order.
Where a problem can reasonably be resolved through repair, adjustment, replacement or reinstallation, Modern Screens may offer that remedy instead of a monetary refund.
17. Customer Responsibilities
Customers are responsible for:
Providing accurate information
Confirming measurements where supplied
Confirming product specifications
Providing reasonable access to the property
Making payments on time
Using the products appropriately
Following maintenance instructions
Reporting defects or problems promptly
Failure to meet these responsibilities may affect delivery, installation, warranty or refund eligibility.
18. Photographs and Project Documentation
Modern Screens may take photographs of completed work for installation records, quality control or internal documentation.
Where photographs are intended for public marketing and may identify the customer or their private property, appropriate permission will be sought where required.
Customers may contact Modern Screens with concerns regarding the use of project photographs.
19. Website Use
Information on the Modern Screens website is provided for general informational and commercial purposes.
We aim to keep information accurate and current, but product availability, specifications, prices, photographs and other website content may change without notice.
Website images may be illustrative and may not always represent the exact finish, colour or configuration of a customer's installation.
20. Intellectual Property
Unless otherwise stated, content appearing on the Modern Screens website and official marketing materials, including logos, photographs, graphics, text, designs and branding, belongs to Modern Screens or is used with appropriate permission.
You may not reproduce, copy, modify, distribute or commercially use our content without permission.
21. Third-Party Services
Modern Screens may use third-party providers for payment processing, communication, website hosting, delivery, analytics or other business functions.
Where a third party processes information or provides a service, its own terms and policies may also apply.
Modern Screens is not responsible for the independent policies or actions of third-party service providers outside our reasonable control.
22. Limitation of Liability
To the extent permitted by applicable law, Modern Screens will not be responsible for losses arising from circumstances outside our reasonable control.
This may include delays caused by severe weather, transport disruptions, supplier delays, restricted property access, government restrictions, utility interruptions or other unforeseen events.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
23. Force Majeure
Modern Screens will not be considered in breach of these Terms where performance is prevented or substantially delayed by circumstances beyond our reasonable control.
We will make reasonable efforts to communicate significant delays and, where practical, agree on an alternative arrangement with the customer.
24. Complaints and Disputes
If you have a concern about a product, installation or service, please contact Modern Screens as soon as possible.
We will review the issue and, where appropriate, inspect the installation or product before determining the appropriate remedy.
We encourage customers and Modern Screens to resolve complaints through good-faith communication before pursuing formal dispute-resolution processes.
25. Privacy
Modern Screens collects and uses customer information in accordance with our Privacy Policy.
By using our services, you acknowledge that certain information may be required to process quotations, orders, payments, deliveries, installations and customer support.
26. Changes to These Terms
Modern Screens may update these Terms of Service from time to time to reflect changes in our business, products, services or legal requirements.
The updated version will be published or otherwise made available to customers.
The Terms applicable to an existing order will generally be those agreed at the time the order was placed, unless otherwise required by law.
27. Governing Law
These Terms of Service are intended to be interpreted in accordance with the applicable laws of Kenya.
Where a dispute cannot be resolved through direct communication, the parties may pursue the appropriate dispute-resolution process available under Kenyan law.
28. Acceptance of These Terms
By requesting a quotation, approving an order, making a payment or instructing Modern Screens to proceed with supply or installation, you acknowledge that you have read and accepted these Terms of Service.
